TERMS OF BUSINESS
In placing an order with us online and completing the checkout process you are accepting our Terms of Business.

Plants

Great care is taken to ensure that all plants sent out from the nursery are true to type and free from pests and diseases.

The plants on our website are generally in stock when you place your order. Occasionally, the availability of these plants can be affected by adverse weather conditions and external factors beyond our control.

If a plant on your order is out of stock, we will contact you by telephone or email before taking payment to confirm when the plant will become available if you wish to reserve it in advance, or to arrange a substitution. We will not substitute plants without contacting you first.

Sizes and measurements of plants on our website are approximate as they can vary significantly in size between seasons.

Plant pot sizes may vary from time to time from the approximate sizes stated online. We will however supply the best plants currently available.

Every effort is made to ensure plants are dispatched in good condition, true to name and pest free, but are sold without warranty. Any complaints will be dealt with on their own merits. Liability is limited to the purchase price of the plants.

Dormant Plants

During the winter we sometimes send out dormant herbaceous plants.  These plants will arrive without any leaves or top growth.  These plants need to be planted out or potted up and treated the same as plants with tops.  In the spring they will begin growing again.

Orders.

Confirmation of your order will be sent by e-mail, and we aim to deliver your order within 3 weeks during the growing season.

The minimum order is for 3 plants. We reserve the right to delay despatch of plants if awaiting part of the order to become available.

Acknowledgement of an order does not constitute an acceptance of the order or an undertaking to supply the plants ordered. Orders are accepted subject to availability of plants.
We do not currently dispatch plants outside the growing season.

To avoid plants being stored by the delivery service over the weekend orders are usually dispatched on a Monday or Tuesday. Acceptance of orders does not guarantee supply.

Payment

Strictly payment with order. If not using the online facility cheques should be made payable to ‘The Herb Patch’ Credit cards are processed online using Paypal. We do not hold any credit card details.
Delivery

Orders are normally delivered by first class post or by parcelforce. A signature will not be required but if you wish to email us additionally with a safe place for your parcel to be left then this information will be included on the delivery details. 

(Highlands and Islands – delivery times and cost may vary depending on distance and courier charges. Please contact us if you live in these areas and would like to place an order.).

We cannot be responsible for weather conditions or after care of plants following delivery.

Unpacking

Our plants are in good condition when they are despatched to you – when you receive them please follow the instructions below to ensure that they remain healthy and give you pleasure for many years to come:

Please check the contents of your parcel against your invoice.

Unpack your order straight away and stand plants upright to allow them to straighten. Plant when weather permits and water in well. If you can not plant out straight away, then plants should be potted up and watered well until planting time.

Complaints

Any complaints must be submitted within 72 hours of delivery, otherwise we assume goods arrived in good condition. We cannot be responsible for loss/damage beyond our control..

Cancellation and Returns

You may cancel your order before plants have been dispatched, up to 7 days after your e mail confirmation of receipt of order has been received. Plants are perishable and therefore you do not have the right to cancel plants once they have been dispatched/delivered unless they are damaged, faulty or miss-described.
